Privacy Notice

Desi Patent Marka Limited Şirketi, trading in English as Desi Patents & Trademarks Limited (“Desi Patent” or the “Company”), processes your personal data as data controller in accordance with Personal Data Protection Law No. 6698 (the “Law”) and related legislation. This notice is provided under Article 10 of the Law.

2. Personal Data We Process

When you use our services, contact us or visit our website, we may process the following personal data:

• Identity data: name, surname, title, Turkish ID or tax number
• Contact data: telephone number, email address, postal address
• Client transaction data: trademark, patent, design and utility model application and registration details, file numbers, your requests and correspondence
• Legal transaction data: powers of attorney, oppositions, actions taken against refusal decisions and information on court proceedings
• Financial data: invoice and payment details
• Transaction security data: DesiIPSoft® Client Portal username, login records, IP address

3. Purposes of Processing

We process your personal data in order to:

• carry out application, registration, opposition, renewal and monitoring procedures relating to industrial property rights
• carry out proceedings before the Turkish Patent and Trademark Office, the courts and other public authorities
• file and monitor applications abroad through foreign attorneys
• manage contracts, invoicing and collections
• provide the DesiIPSoft® Client Portal and keep it secure
• respond to your requests and questions
• comply with legal obligations and protect rights in the event of a dispute

4. Collection Methods and Legal Grounds

Your personal data is collected by automated or non-automated means through email, telephone, our website, the DesiIPSoft® Client Portal, written documents and the records of public authorities. It is processed on the following legal grounds under Article 5 of the Law:

• processing is directly related to the formation or performance of a contract
• processing is necessary for the data controller to fulfil a legal obligation
• processing is necessary for the establishment, exercise or protection of a right
• processing is necessary for the data controller’s legitimate interests, provided that it does not harm your fundamental rights and freedoms
• your explicit consent, where required

5. Transfer of Personal Data

For the purposes above, your personal data may be transferred to the Turkish Patent and Trademark Office, the courts and other competent public authorities, and to our accounting, legal and information technology service providers.

Where you request protection abroad, the data needed to make the application is transferred to the intellectual property offices of the relevant countries, to international organisations such as the World Intellectual Property Organization (WIPO), the European Union Intellectual Property Office (EUIPO) and the European Patent Office (EPO), and to foreign attorneys. These transfers are made in accordance with Article 9 of the Law, where necessary for the performance of a contract or the establishment of a right, or subject to appropriate safeguards.

6. Desi Portal Android App

The Desi Portal app on Google Play opens the DesiIPSoft® Client Portal on your device. It has no content of its own, and the data shown in the app is the same data shown in the portal.

• The app connects to the portal at portal.desipatent.com over an encrypted (HTTPS) connection.
• The username and login records described in Section 2 are processed when you sign in. Cookies keep your session open.
• Documents you choose to download are saved to the Downloads folder of your device.
• The app does not access your location, contacts, camera, microphone, messages or call logs, and it does not show advertising.

7. Retention and Deletion

We keep your personal data for as long as the purposes above require and for the periods set by applicable legislation. When these end, the data is deleted, destroyed or anonymised.

To close your portal account or to request deletion of your data, email desi@desipatent.com.tr. Records that we are legally required to keep, and public records held by intellectual property offices, cannot be deleted through this request.

8. Your Rights under Article 11 of the Law

By applying to the Company, you have the right to:

• learn whether your personal data is being processed
• request information if it has been processed
• learn the purpose of processing and whether the data is used accordingly
• know the third parties in Türkiye or abroad to whom it has been transferred
• request correction if it is incomplete or inaccurate
• request its deletion or destruction under the conditions of Article 7 of the Law
• request that third parties to whom it was transferred be notified of any correction, deletion or destruction
• object to an outcome against you arising solely from analysis by automated systems
• claim compensation for damage caused by unlawful processing

9. How to Apply

You may send your request in writing to the address above, in line with the Communiqué on the Procedures and Principles for Applications to the Data Controller, or by email to desi@desipatent.com.tr from your email address registered in our system. Your application will be concluded free of charge within 30 days at the latest.
